These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the sale of products made through the website www.galayaofficiel.com.
Article 1 — Seller Identity and Purpose

These Terms define the rights and obligations of GALAYA and any individual acting as a consumer (hereinafter the “Customer”) in connection with the purchase of products offered on the website.
These Terms apply to distance sales made through the website www.galayaofficiel.com.
They are available at all times on the website.
Article 2 — Acceptance of the Terms
Any order placed on the website implies that the Customer has read and accepted these Terms before final confirmation of the order.
The Customer is invited to review these Terms before proceeding with payment.
The Terms applicable to an order are those in force on the website at the time the order is placed.
GALAYA recommends that the Customer keep a copy of these Terms on a durable medium.
Confirmation of the order creates an obligation to pay.
Article 3 — Products
GALAYA sells, in particular, sportswear, clothing designed for Pilates, Yoga and Wellness activities, as well as related accessories.
The essential characteristics of each product are presented on its product page, including depending on the product:
- product name;
- composition;
- color;
- available sizes;
- functional characteristics;
- usage or care instructions;
- price;
- availability;
- photographs.
The Customer is invited to carefully review the information displayed on the product page before placing an order.
GALAYA strives to provide descriptions and photographs that are as accurate as possible regarding the products sold.
However, photographs, product displays and graphic representations are provided for illustrative purposes. Minor differences in color or appearance may result from the settings of the Customer’s screen.
Such differences do not affect GALAYA’s obligation to deliver a product that complies with the essential characteristics described and with the order placed.
Article 4 — Product Availability
Product offers are valid while they remain visible on the website and within the limits of available stock.
Availability displayed at the time of purchase is provided based on information known by GALAYA.
In the exceptional event that a product becomes unavailable after order confirmation, GALAYA will inform the Customer as soon as possible.
Depending on the circumstances, the Customer may:
- accept a replacement solution proposed by GALAYA;
- wait for restocking if possible;
- or request cancellation and a refund for the unavailable product.
No replacement product will be imposed on the Customer without their agreement.
Article 5 — Prices
The prices of products offered on the website are displayed in euros (€), including all applicable taxes (VAT included) for orders subject to French VAT.
The applicable price is the one displayed at the time the order is confirmed.
GALAYA reserves the right to modify its prices at any time for future orders.
Any price change occurring after order confirmation shall have no effect on that order.
Any applicable delivery fees are displayed separately before final confirmation of the order.
Before payment, the Customer can therefore know the total amount due, including:
- product prices;
- applicable taxes;
- discounts;
- applicable delivery fees.
For international deliveries outside territories covered by the taxation applied at checkout, customs duties, import taxes or local fees may be required by the authorities of the destination country.
When these amounts are not collected directly by GALAYA at the time of purchase, they may remain payable by the recipient.
Article 6 — Ordering Process
The Customer selects the products they wish to purchase and adds them to their cart.
Before completing the order, the Customer may review:
- selected products;
- sizes;
- colors;
- quantities;
- price;
- delivery address;
- delivery method;
- associated fees;
- total order amount.
The Customer may correct any errors before final confirmation.
To place an order, the Customer must:
- select the product(s);
- add them to the cart;
- provide their contact details;
- provide their delivery address;
- select an available delivery method;
- review order information;
- accept these Terms;
- select a payment method;
- confirm the order and payment obligation.
The website indicates accepted payment methods and any delivery restrictions before final confirmation of the order.
Article 7 — Order Confirmation
Following order validation and subject to payment acceptance, GALAYA sends the Customer an order confirmation email to the email address provided during checkout.
This confirmation includes the essential information relating to the order.
The Customer must verify the accuracy of the information contained in the confirmation.

The Customer remains responsible for the accuracy of the information provided, including email address and delivery address.
Article 8 — Payment
Payment methods that may be offered on the website include:
- Visa;
- Mastercard;
- American Express;
- PayPal;
- Apple Pay;
- Google Pay;
- Alma, where installment payment is available.
The actual payment methods offered are those displayed during checkout.
Payment is due at the time of ordering, unless an explicitly offered installment payment method provides for a different schedule.
When using an installment payment provider such as Alma, the provider’s specific terms apply in addition to these Terms.
GALAYA does not directly store complete Customer banking details when they are processed by secure payment providers.
GALAYA may refuse or suspend an order in cases including:
- payment authorization refusal;
- reasonable suspicion of fraud;
- clearly incorrect information;
- or payment disputes relating to previous orders, subject to consumer rights.
Article 9 — Delivery
Products are delivered to the destinations offered on the website during checkout.
The Customer must provide a complete and accurate delivery address.
Applicable delivery methods, prices and estimated delivery times are communicated to the Customer before final confirmation of the order.
GALAYA indicates, depending on the destination:
- available delivery methods;
- delivery cost;
- estimated or agreed delivery time;
- any delivery restrictions.
A dedicated “Shipping Policy / Delivery Policy” page supplements these Terms.
In the event of a contradiction between general commercial information and the precise information displayed to the Customer at checkout, mandatory legal provisions and commitments expressly accepted during the order shall apply.
Article 10 — Delivery Delays
GALAYA undertakes to deliver products on the date or within the timeframe indicated to the Customer at the time of purchase.
Where no specific delivery period has been announced, applicable legal delivery rules remain applicable.
In case of delivery delay, the Customer benefits from the rights provided under the French Consumer Code.
The Customer may contact GALAYA at:
to obtain information regarding the status of their order.
Any delays attributable to the carrier do not deprive the Customer of their rights against GALAYA as seller.
Article 11 — Transfer of Risks and Receipt of Products
When GALAYA arranges transportation of the product, the risk of loss or damage to the product transfers to the Customer when the Customer physically takes possession of the product, or when a third party designated by the Customer, other than the carrier, takes possession of it.
Upon receipt, the Customer is invited to check the condition of the package and the products.
In the event of a missing product, damaged product, or product different from the one ordered, the Customer is invited to contact GALAYA as soon as possible at:
by providing the order number and, where useful, photographs allowing identification of the issue.
This recommendation does not affect the Customer’s legal guarantees.
Article 12 — Legal Right of Withdrawal
In accordance with the provisions of the French Consumer Code applicable to distance sales, the consumer Customer has a legal period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.
When several products belonging to the same order are delivered separately, the withdrawal period is calculated according to the applicable legal rules.
The Customer may notify their decision to withdraw:
- using the standard withdrawal form included at the end of these Terms;
- through a clear statement expressing their intention to withdraw;
- by email at contact@galayaofficiel.com;
- or through the withdrawal functionality available on the website.
The notification must allow the relevant order to be sufficiently identified.
Online Withdrawal Functionality
GALAYA provides the Customer with an online functionality allowing them to exercise their right of withdrawal, in accordance with legal requirements applicable to distance contracts concluded through an online interface.

This functionality must remain easily accessible throughout the legal withdrawal period.
The exercise of the legal right of withdrawal cannot be subject to providing a reason.
Article 13 — GALAYA 30-Day Commercial Return Policy
Regardless of the legal 14-day withdrawal period, GALAYA grants its Customers a commercial return policy allowing eligible products to be returned up to 30 days from receipt of the products.
This commercial extension does not reduce any consumer legal rights.
To benefit from the commercial return policy beyond the legal withdrawal period, the product must notably be:
- unwashed;
- undamaged;
- not worn beyond what is necessary for fitting purposes;
- accompanied by its original tags;
- returned with any applicable accessories.

Article 14 — Return Procedures
To request a return, the Customer may contact:
by providing, in particular:
- their name;
- their order number;
- the product(s) concerned.
GALAYA will then provide the applicable return instructions.
When the Customer exercises their legal right of withdrawal, products must be returned within the deadlines provided by applicable regulations.
Return shipping costs: GALAYA covers return shipping costs for customers.
In the event of a defective, non-compliant, damaged or incorrectly shipped product, legal warranty rules and seller liability provisions shall apply.
Article 15 — Condition of Returned Products
The Customer may handle and try the product only to the extent necessary to establish its nature, characteristics and proper functioning, in a manner comparable to what could reasonably be done during a fitting.
The Customer may be held responsible for any depreciation resulting from handling beyond what was necessary to examine the product, in accordance with applicable regulations.
For returns made solely under the 30-day commercial return policy after expiry of the legal withdrawal period, GALAYA may apply the commercial conditions provided in its return policy, provided that these conditions do not reduce any legal rights of the Customer.
Article 16 — Exceptions to the Right of Withdrawal
The right of withdrawal does not apply where the law expressly provides for an exception.
This may include, where applicable:
- products made according to the Customer’s specific requirements or clearly personalized;
- products which, after being unsealed, cannot be returned for health protection or hygiene reasons, where the legal conditions for such an exception are met.
GALAYA applies an exception to the right of withdrawal only where it is legally applicable to the product concerned.
Simply opening a package or normally trying on a garment does not automatically remove the legal right of withdrawal.
Article 17 — Refund After Withdrawal
In the event of a valid exercise of the legal right of withdrawal, GALAYA refunds the amounts due in accordance with the deadlines and procedures provided by the French Consumer Code.
The refund is made using the same payment method used for the original transaction, unless the Customer expressly agrees to another method that does not result in additional costs.
GALAYA may postpone the refund under the conditions permitted by applicable regulations, including until the product has been recovered or until proof of shipment has been received where permitted by law.
In case of withdrawal concerning the entire order, the delivery costs corresponding to GALAYA’s standard delivery option are refunded under the conditions provided by law.
Additional costs resulting from the Customer choosing a more expensive delivery method than the standard delivery option offered are not necessarily refundable.
Article 18 — Legal Guarantee of Conformity
GALAYA is required to provide the Customer with a product that complies with the contract.
The Customer benefits from the legal guarantee of conformity for two years from delivery of the product, under the conditions provided by the French Consumer Code.
In case of lack of conformity, the Customer benefits from the rights provided by applicable regulations, including repair, replacement, price reduction or contract termination where legal conditions are met.
Bringing the product into conformity is carried out free of charge for the consumer under the conditions provided by law.

Regulatory Information Regarding Legal Guarantees
IMPORTANT: Before publication, insert here the official regulatory information box applicable to sales of goods provided under Article D.211-2 and its appendix of the French Consumer Code.
This regulatory information box must notably inform consumers about:
- the two-year duration of the legal guarantee of conformity;
- repair or replacement of the product;
- the applicable period for bringing the product into conformity;
- the absence of costs for the consumer;
- circumstances allowing a price reduction or termination of the sale;
- the effects of repair or replacement on the duration of the guarantee;
- the legal guarantee against hidden defects.
Article 19 — Guarantee Against Hidden Defects
The Customer also benefits from the legal guarantee against hidden defects under the conditions provided by Articles 1641 and following of the French Civil Code.
This guarantee may apply when a hidden defect existing under the conditions provided by law makes the product unsuitable for its intended use or significantly reduces its use.
Where legal conditions are met, the Customer benefits from the remedies provided by the French Civil Code.
Article 20 — GALAYA 30-Day Commercial Guarantee
The 30-day return policy offered by GALAYA constitutes an additional commercial benefit.
It supplements legal guarantees and does not replace them.
Legal guarantees of conformity and against hidden defects remain applicable independently of the expiry of the 30-day commercial return period.
Article 21 — Liability
GALAYA is responsible for the proper performance of its obligations arising from the distance contract concluded with the Customer, under the conditions provided by applicable regulations.
However, GALAYA shall not be held liable for damage resulting exclusively from:
- a fault by the Customer;
- use of the product contrary to its intended purpose or to the instructions provided;
- an unforeseeable and unavoidable act of a third party to the contract;
- or a force majeure event recognized as such under applicable law.
No provision of these Terms is intended to exclude or limit any right or compensation to which the Customer is mandatorily entitled under applicable law.
Article 22 — Force Majeure
GALAYA shall not be held liable for failure to perform its obligations when such failure results from an event meeting the legal criteria of force majeure.
Where the event is temporary, performance of the affected obligation may be suspended for the duration of the impediment under the conditions provided by applicable law.
Where appropriate, GALAYA shall inform the Customer of the consequences of such an event on the order.
Mandatory consumer rights remain applicable.
Article 23 — Intellectual Property
The GALAYA trademark and all elements composing the website, including logos, graphic creations, photographs, videos, texts, illustrations, designs, models and presentation elements, are protected by applicable intellectual property rights where they belong to GALAYA or are used with authorization from their respective owners.
Any unauthorized reproduction, representation, adaptation, exploitation or use of such elements that may infringe the rights of their owners is prohibited.
The purchase of a product does not grant the Customer any intellectual property rights over the GALAYA brand, creations or content.
Article 24 — Personal Data
GALAYA processes personal data necessary in particular for:
- order management;
- payment processing;
- delivery;
- customer service;
- returns;
- fraud prevention;
- compliance with legal obligations;
- and, where permitted by regulations, commercial communications.
Details regarding the collection and processing of personal data are provided in the Privacy Policy available on the website.
The Customer may exercise their rights in accordance with applicable regulations by contacting GALAYA using the contact details provided in this policy.
Article 25 — Evidence and Contract Storage
Data recorded by the systems used by GALAYA and its service providers may constitute evidence of orders and transactions, subject to applicable legal rules.
GALAYA retains electronically concluded contracts where regulations require such archiving.
For contracts subject to legal archiving obligations, the Customer may request access to the retained contract by contacting:

Article 26 — Customer Service and Complaints

To facilitate processing of the request, the Customer is invited to provide their order number whenever available.
GALAYA strives to respond to complaints as quickly as possible.
Article 27 — Consumer Mediation
In the event of difficulty, the Customer is invited to first submit a written complaint to GALAYA in order to seek an amicable solution.
If the dispute cannot be resolved directly with GALAYA, the consumer Customer may use, free of charge, the consumer mediator applicable to GALAYA, subject to the applicable admissibility conditions.

Article 28 — Applicable Law
These Terms and contracts concluded with GALAYA are governed by French law.
Where the Customer resides in another country benefiting from mandatory consumer protection provisions, the application of French law shall not deprive the Customer of the mandatory protections granted under the applicable regulations.
Article 29 — Dispute Resolution and Jurisdiction
In the event of a dispute, GALAYA and the Customer are encouraged to seek an amicable solution as a priority.
The Customer may also, where applicable conditions are met, use the consumer mediator designated in the previous article.
If no amicable resolution is reached, the dispute may be brought before the competent courts in accordance with applicable legal rules.
The consumer may notably bring proceedings before the territorially competent court under applicable procedural rules or, where provided by law, before the court of the place where they resided at the time of entering into the contract or where the harmful event occurred.
No provision of these Terms requires the consumer to submit exclusively to the courts of Paris where another jurisdiction is available under applicable law.
Article 30 — Modification of the Terms
GALAYA may modify these Terms for future orders, in particular in order to take into account:
- changes to its services;
- changes to its business activity;
- regulatory or legislative developments;
- technical changes to the website.
Changes shall not apply retroactively to orders already concluded.
The applicable version is the one accepted by the Customer at the time of purchase.
